Is my Medical Web Forms™ account HIPAA Compliant?
Yes; we've provided you with an environment of technical security that meets and exceeds the requirements for data encryption. In addition, each time your patients log in to the system, they are provided with your Notice of Privacy Practices. The patient is required to acknowledge the receipt of such notice prior to entering the system.
The HIPAA security standards for electronic protected health information (ePHI) are set forth in 45 CFR Section 164.306. We have designed Medical Web Forms™ to conform to such standards. The rules require that we agree to comply with these rules pursuant to a Business Associate Agreement or other written agreement. We have complied with such requirement under the Term of Access and Use, which is a binding agreement between you, the provider, and Vital Element. This agreement requires us to follow the administrative and technical requirements of HIPAA to protect ePHI you or your patients provide to the system.
The HIPAA security standards do not set forth any particular requirements for encryption because of the pace at which development of technology changes. In addition, not all standards may be necessary for all types of use or transmission of ePHI. The Security Rule allows covered entities the flexibility to determine when, and whom, and what method of encryption to use. The final rules have determined that “network industry standards” are a sufficient safeguard to protect transmitted ePHI. We use encryption that is consistent with the industry standard or better.
Can my patients fill medical forms out online?
